Terms and Conditions of Agreement
CONSULTATION: We offer a free (up to 2 hours) Initial Consultation at the Visual Lyrics home studio and if desired, up to one hour consultation to finalize your order. Additional in person and on-site consultations will be $50.00 for up to one hour and an additional $50.00 for every hour thereafter. Telephone conferences are available by appointment.
PAYMENT OPTIONS: Payment Option 1: Deposit in the amount of 50% of estimated total cost due upon reserving the event date and final payment of the remaining balance plus any additions due one month prior to the event date. Payment Option 2: Deposit in the amount of one third of the estimated cost due upon reserving the event date, one third of the total estimated cost due three months prior to the event and final paymne tof remaining balance plus additions due one month prior. Payment Option 3: Pay in full upon reserving the event date. If reservation date is one month or less prior to the event date, option 3 must be used.
DEPOSIT: Deposits are non refundable unless, at the sole discretion of Visual Lyrics, unusual circumstances warrant a refund. We recommend that if your wedding date is in March, April, May, September or October, you make your deposit as early as possible to ensure your event date.
FINAL PAYMENT: The final payment is due one month prior to the event. Payments made after that date may require an additional fee to ensure timely delivery of flowers and supplies and/or certain flowers or supplies may become unavailable. If final payment is not received, this agreement may be terminated with no refunds given.
CHANGES: Additions and subtractions may be made to the order any time up until the final payment due date, providing the requested deductions do not exceed 25% of the contracted amount. After final payment is due, no further subtractions may be made to the order, though additions up until 14 days prior to the scheduled event may be made. All requests for changes to the invoice must be sent to us in writing, either by mail, email or fax, even if they have been discussed by telephone. Requests for additions less than 14 days prior to the wedding/event may or may not be honored depending on the availability of product, equipment, or other factors beyond the control of Visual Lyrics.
PAYMENT: Payments may be made by cash, check or money order, or by Visa, Mastercard, American Express or Discover. Payments may be mailed to 109 S HWY 183, Leander, Texas 78641. The cost for additions made prior to the final payment due date will be added to the final payment amount. Additions made after the final payment due date require immediate payment.
RENTAL ITEMS: Containers, candle stands, arches and other items are rental items. In the case that these items are not returned to us, you will be charged a replacement fee in addition to the rental fee. If our containers or equipment are lost or damaged, the replacement fee will be due within one month of the event. If payment is not received within one month of the event, the credit card on file will be charged.
PRODUCT SUBSTITUTION: Occasionally factors beyond the control of Visual Lyrics may influence the quality of product and flowers to be used in your wedding/event which must be considered. If for any reason the product for this event arrives damaged, becomes unavailable, or is for any reason un-presentable, including the wrong color or size, Visual Lyrics reserves the right to substitute with product of equal value.
SIGNATURES: Visual Lyrics must have signed copies of the Floral Cost Agreement, the revised Floral Cost Agreement, this Terms and Conditions of Agreement and the final outline to complete your order. If a signed copy of the final outline is not returned, Visual Lyrics can not be responsible for any items that were not listed in the outline provided to you.
DELIVERY: The delivery fee is 20% of the subtotal. Out of town deliveries (Marble Falls, Kyle, Buda, Dripping Springs, Driftwood, etc.) have an additional fee of $0.50 per mile outside of the Austin metropolitan area, round trip. The minimum subtotal for out of town deliveries is $3000.00. The minimum delivery fee is $100.00. Orders of less than $500.00 have the option of picking up the order to avoid the delivery fee. Deliveries that do not require our staff to return to the event to pick up items (all items including containers are purchased or provided) have a fee of 15% of the subtotal. Items to be moved from the ceremony to the reception have an additional fee of 20% of those items or $50.00, whichever is greater.
ADDITIONAL CONDITIONS: All sketches are the property of Visual Lyrics and are not to be used by other vendors unless by written permission from a member of Visual Lyrics. Additional set up not listed in the order, including helping your House Party members with corsages and boutonnieres or placement of other items including fabric, will be $50.00 per hour, with a minimum of 1 hour. Schedule accordingly so that a Visual Lyrics staff member is available to you on your event day. All containers and glassware provided by you must be clean with tags removed or a cleaning fee may apply. Visual Lyrics will not be responsible for placing an aisle runner that is not provided by us unless prior arrangements are made. (Without the proper equipment and supplies, the aisle runner may not be placed correctly and could be a danger.) Wedding cake vendors that would like Visual Lyrics to provide cake flowers to them prior to our scheduled delivery time may arrange to pick up the flowers prior to the event date. Visual Lyrics can not be held accoutable for any circumstances beyond our control regarding your event, including extreme weather, wind and heat.
Terms and Conditions of Agreement
Vintage Items and Antiques Many of our vintage items and antiques have slight imperfections due to age and wear. We call this “character.” Many of our vintage and antique pieces are one-of-a-kind and subject to availability at the time of the order.
Delivery and Pick Up A Vintique Rentals staff member will deliver, set up and pick up all rental items. Pick up is available for small items. A late fee may apply if items are returned after the contracted return time.
Delivery fees are dependent upon distance, quantity and requested services. A Vintique Rentals staff member is available to stay on site and reset the scene for various poses during portrait sessions.
Payment A deposit of 50% of the total is due upon ordering to reserve your rental item(s). The remaining 50% plus a refundable deposit is due 10 days prior to the event. Payment may be made by check, cash, money order, Visa, Mastercard or Discover. Checks and money orders should be made to Visual Lyrics (our parent company) and sent to 109 S HWY 183, Leander, Texas 78641. Credit card merchant receipts will list Visual Lyrics as the payee.
Damage Deposit The Damage Deposit amount is dependent on the type of rental item. Damage Deposits are returned within 10 days of the event if the items are returned undamaged. Damaged items will be charged the full replacement fee and subtracted from the deposit. Any remaining deposit will be returned to the client within 10 days of the event. Preferred form of deposit is check, money order or credit.
Replacement If the replacement fee exceeds the deposit amount, the client agrees to pay any additional fees within 30 days of the event. Vintique Rentals will inform the client of any additional replacement fees within 10 days of the event. If the client fails to pay any additional fees within 30 days of the event, a late fee of $50.00 will be added to the remaining balance plus $5.00 every day until payment has been made in full.
Cancellation If cancellation is made 30 days or more prior to the event, the deposit will be refunded. If cancellation is made between 10 and 30 days prior to the event, the deposit minus 50% will be refunded. If cancellation is made less than 10 days prior to the event, no refund on the deposit will be given.
Responsibility Vintique Rentals can not accept liability for any injury or damages involving the rental items and equipment. In the unlikely event that a rental item malfunctions or is damaged during delivery, we will attempt to repair or replace it. The client takes full responsibility for the rental item(s) between the time of delivery and pick up.
